Upper body injury claim FAQs

How long do I have to make an upper body injury claim?

You’ll generally have three years to make an upper body injury claim. This could be three years from the date of your accident or from when you first became aware of your injuries. For example, if you’d suffered medical negligence and did not realise until a later diagnosis revealed your condition.

There are some cases where this time limit won’t apply, though. If you’re claiming on behalf of a child who has sustained upper body injuries, you’ll have until their 18th birthday to make a claim. After this, the child will have until their 21st birthday to build their own case.

Sadly, there are some instances where upper body injuries are fatal. If you’re considering making a claim on behalf of a loved one who has passed away, you will usually have three years from the date of their death to start the process.

How much compensation could I receive for an upper body injury?
