Can I make an angle grinder accident claim?

Angle grinders are common tools in construction, as well as other industries. Used for tasks like cutting stone or metal, they can also be dangerous. The discs inserted into angle grinders can be incredibly sharp and powerful, meaning that serious injuries can happen.

Angle grinder accidents are a reality for many. But if you’ve suffered an angle grinder injury at work, you could be able to make a compensation claim.

This is because your employer is responsible for your safety. If they have failed in this duty, you could hold them responsible for any accidents. Their obligations to you include:

  • Providing training

You could be able to claim compensation if your employer did not provide the proper training for using an angle grinder. They are required to carry out a risk assessment that sets out the risks to employees.

During the risk assessment, your employer should realise that training will be necessary for certain tools and machines. The Health and Safety Executive (HSE) advises that “there is no substitute for thorough practical training in all aspects of the mounting and use of abrasive wheels”.

  • Maintaining equipment

You could also make a claim if your injury was caused by a faulty angle grinder. Your employer is supposed to ensure that all the equipment you use as part of your job is safe to use. Equipment and tools should be maintained and regularly inspected to ensure their safety.

If they aren’t and you were injured by an unsafe angle grinder, you could be able to make a claim against your employer.

Angle grinder injuries

An angle grinder could injure you in a number of ways. The spinning wheels are abrasive enough to cut through materials like stone, so they have the potential to cause serious injuries to you.

Some of the most angle grinder injuries include:

  • Cuts and lacerations
  • Eye injuries – particularly when debris is sent flying from where the tool is being used
  • Loss of fingers or hands
  • Vibration white finger – this is caused by the continuous use of handheld power tools

You may also have suffered from lung disease after constantly inhaling the dust produced by using an angle grinder. This

How much can I claim for an angle grinder accident?

Every workplace accident and injury is different. That makes it difficult to say exactly what you might be entitled to in compensation without finding out the details of what happened to you.

You could use our compensation calculator to get a rough idea of what you may be entitled to for your injury.

But you could also be able to claim for any financial losses your injury caused you to suffer. This could include lost earnings if you had to take time off work and weren’t paid. It could also cover any medical treatment, including medication, and the cost of travel to and from medical appointments.

Your solicitor will be able to give you a clearer idea of what you may be entitled to – and they will do all they can to ensure you get the appropriate amount of compensation.

How long do I have to make a claim?

You’ll usually have three years to make your claim. There are very few exceptions to this, so it’s important to make sure you get your claim submitted before the deadline.

And although three years sounds like plenty of time, it’s always a good idea to start your claim as soon as possible. You may find it easier to get hold of certain pieces of evidence, such as any CCTV footage of the accident or your workplace accident book.

You could also find it easier to recall the details of what happened when you start a claim soon after your accident. The same may be true for any witnesses.

How much will a claim cost?

If our solicitors think you have a solid claim, they will usually agree to represent you on a No Win No Fee basis.

This kind of funding agreement means that everyone has access to justice and a chance to receive the compensation they deserve. That’s because there is no upfront fee to pay. Instead of worrying about how to pay for legal action, you can focus on your recovery.

There is also nothing to pay if your claim is unsuccessful. This makes a No Win No Fee agreement a risk-free way of holding someone responsible for your accident.

Only pay a fee if you receive compensation

Our No Win No Fee solicitors will take a success fee from the compensation you are awarded for a successful claim in the form of a percentage of your damages. This could be up to 25% but it won't be more than that, except in cases of road traffic accidents. Changing laws mean our solicitors will now take a payment of 30% of the final compensation amount plus VAT for all road traffic accident claims.

First4Lawyers are an award-winning claims management company with a track record of delivering service that our clients love.

Why should I make an angle grinder injury claim?

We understand how difficult making a claim against your employer may seem. We’ve helped thousands of people who have had these concerns. But there are some important reasons to make a claim, including:

  • Having your accident acknowledged

When compensation is awarded, it means there is an agreement that you were wronged. Although you may not get an apology or even a formal acknowledgement that your employer was responsible, compensation means that you were successful. It means that others agreed that your employer could have stopped the accident happening.

  • Giving you financial breathing room

The compensation you’re awarded for a successful claim can help you take the time away from work that you need to recover. Not working can mean you’re not paid, but your compensation will mean you get some financial breathing room.

  • Stopping it happening to others

By making a claim, you help highlight the problem to your employer. This means that they can then address what went wrong. They may not have realised that there was an issue, which led to your injury. By drawing their attention to what happened, you can help stop it happening to your colleagues.
